Policy Pick: Lactation Accommodation for State Employees

California law requires all public and private employers to provide a reasonable place and break time for an employee to express breast milk. Unfortunately, many employees, including those working in state government, are not aware of the law, and some are afraid to ask for this accommodation in fear of getting fired.

SB 257 (Pavley - Santa Monica), sponsored by the California WIC Association, will raise awareness of lactation accommodations for state employees and will enforce existing law in a non-punitive and educational manner. SB 257 will:

Require state agencies and departments, including local offices, to notify female employees nearing maternity leave about workplace lactation accommodation.

Require the California Department of Public Health (DPH) to post on the DPH website information that includes:

  • lactation accommodation
  • employer requirements regarding break time, space, and penalties for non-compliance with workplace lactation support
  • additional references on breast-feeding support organizations
  • a link to the most recently published version of the "The Employees' Guide to Breastfeeding and Working" as developed by the Health Resources and Services Administration of the US Department of Health and Human Services

First 5 LA supports efforts that encourage breastfeeding since it has significant bonding and health benefits for mother and child. Children who are breast fed are less likely to develop acute ear infections, asthma, diabetes and obesity. Reduced risk of diabetes and breast and ovarian cancer are some of the mother's health benefits.
